Terms of Service
Last updated: August 2026
1. Acceptance of terms
By creating an account, starting a trial, or otherwise using Dischargo, the hospital or facility agreeing to these terms ("Hospital," "you") accepts them in full. If you're accepting on behalf of an organization, you confirm you have the authority to bind that organization.
2. What Dischargo is — and isn't
Dischargo is a post-discharge patient monitoring platform: it sends automated check-in messages over WhatsApp to discharged patients, records their replies, and surfaces risk alerts to the Hospital's care team. Today, patient intake happens by CSV upload or manual entry — direct EHR (e.g. Epic, Cerner) integration is not currently built.
Dischargo is a communication and monitoring tool, not a medical device and not a substitute for clinical judgment. It does not diagnose, treat, or make care decisions. All clinical decisions remain the sole responsibility of the Hospital's licensed practitioners.
3. Hospital responsibilities
- Provide accurate registration and billing information
- Keep account credentials confidential and control which staff have access
- Obtain any patient consent required by law before enrolling a patient in monitoring
- Use the service in compliance with applicable healthcare, privacy, and telecommunications laws in your jurisdiction
- Not rely on Dischargo as a substitute for clinical monitoring in situations requiring immediate medical attention
4. Trial and subscription
New Hospitals may start a 15-day free trial covering up to 20 monitored patients, with no credit card required. After the trial, continued use requires a paid subscription (Starter, Growth, or a custom Enterprise agreement), billed monthly in advance through our billing partner, Paddle, which acts as merchant of record for these charges. Subscription fees are non-refundable except as required by law or expressly agreed in writing.
5. Acceptable use
You agree not to:
- Use the service to enroll or message anyone without appropriate consent or legal basis
- Attempt to access another hospital's data or bypass account isolation
- Reverse engineer, scrape, or attempt to extract the underlying software
- Use the service in a way that violates applicable law, including healthcare and data protection regulation in your jurisdiction
6. Data ownership
The Hospital retains ownership of all patient data and hospital data entered into Dischargo. Dischargo processes that data solely to provide the service, under the terms of the Data Processing Agreement (and, for U.S. Hospitals, the Business Associate Agreement) executed alongside these Terms. Dischargo retains ownership of the underlying software, platform, and any aggregated, de-identified data used to improve the service.
7. Warranty disclaimer
The service is provided "as is." We work to keep it available and accurate, but we do not warrant that it will be uninterrupted, error-free, or that every risk will be detected — Dischargo surfaces signals from patient-reported data; it cannot catch what a patient does not report.
8. Limitation of liability
To the maximum extent permitted by law, Dischargo's total liability arising from these Terms or use of the service is limited to the fees paid by the Hospital in the 12 months preceding the claim. Neither party is liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability that cannot be limited by law, including liability arising from gross negligence or willful misconduct.
9. Termination
Either party may terminate with 30 days' written notice. We may suspend or terminate access immediately for a material breach of these Terms, non-payment, or conduct that puts patient data at risk. On termination, patient data is returned or deleted per the Data Processing Agreement.
10. Changes to these terms
We may update these Terms from time to time. We'll notify Hospital administrators of material changes before they take effect. Continued use after a change takes effect constitutes acceptance.
